Famrut Terms & Conditions

These Terms govern your use of the Famrut (“Famrut Marketplace”) and grants you access to it upon terms and conditions and the right to purchase Products and Services provided by Associates on the Famrut Marketplace. These Terms are entered into (“Famrut”, “we”, “us” and “our”), the entity you represent or you individually (“You / you / your”).

PRICES AND PAYMENT

Payment

You agree to pay all applicable fees /charges related to your use of the Famrut Marketplace Products and Services. The fees/charges are separate and in addition to fees/charges applicable to your use of any other Famrut Products and Services. You shall solely be responsible to pay the bank charges and related fees/charges as the case may be incurred during the performance of these Terms.

Prohibited Content

These content prohibitions apply to any and all traffic that you transmit via the Services. Your Content shall not:.

• be defamatory, obscene, offensive, hateful or inflammatory
• promote violence, sexually explicit material, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age or any other grounds
• infringe any Intellectual Property Rights.
• be likely to false, deceive or mislead.
• promote, advocate, incite or assist any illegal activities.
• be threatening, abuse, violate or invade third party's privacy; or
• contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.

Orders

The prices and payment methods under these Terms shall be subject to those specified in the order on Famrut Marketplace. The pricing at any time may be adjusted at Associate’s discretion. Prices are exclusive of all taxes, such as withholding tax, VAT, sales tax, goods and service tax (GTS) or any similar or analogous or any other tax applicable in a relevant territory if any, which shall be charged in addition thereto in accordance with the relevant laws and regulations in force at the time of making the relevant taxable supply.

Invoicing

We will issue an invoice to you if we are legally obligated by a local authority to do so. You agree that such invoicing by us does not and will not obligate us in any way or form in the rendering of the Famrut Marketplace Services that you are purchasing from the Associate and do you agree that we will not assume any liabilities and / or responsibilities for the Famrut Marketplace Products and Services provided by Associates. Any liability or responsibility related to Famrut Marketplace Products and Services is solely assumed by Associates.

Taxes

Each Party is responsible, as required under applicable laws and regulations, for identifying and paying all taxes and other governmental fees and charges (and any penalties, interest, and other additions thereto) that are imposed on that Party upon or with respect to the transactions and payments contemplated under this Agreement. If any other taxes (including but not limited to cross-board tax withholding) are required by law to be levied on any payment, you shall make extra payments to ensure that we would have received payment equal to the amount no taxes had been required. In such circumstances, you will use reasonable efforts to minimize any such taxes to be withheld to the extent legally allowed (including to the extent allowed by the operation of any applicable double taxation agreements or treaties) including the filing of any documents with any relevant taxation authority. You agree to provide us with evidence(s) upon request that any such withholding tax has been timely and properly remitted to the relevant tax authorities within 60 days after the payment is made.

Refunds

In the event that you apply for a refund and we confirm that the application meets the refund requirements/eligibility criterion provided by Associate, we will send a refund notification to You and the Associate. When we get the final and independent confirmation from Associate, then we will refund to you for the Famrut Marketplace Products and Services in question, strictly in accordance with the refund process /eligibility criterion of Famrut Marketplace, and refund shall be exclusive of all kinds of related Taxes. Famrut Marketplace does not guarantee/assure any refund to you and same shall always be subject to an independent policies/eligibility criterion of the Associate and not otherwise. There shall be no default liability on the part of Famrut Marketplace in this regard in any manner whatsoever.

Cancellation

You further agree that we will be entitled to suspend or cancel your access to Famrut Marketplace Products and Services in the event of You being unable to make on-time and full payment(s) for the Products and Services you are purchasing. Such cancellation or suspension may result in your data loss. There shall be no default liability on the part of Famrut Marketplace in this regard in any manner whatsoever.

USE AND SUPPORT

Use of Famrut Marketplace Product and Services

If you can perform the following operations after logging in to the Famrut Marketplace, it is deemed that Famrut Marketplace Products and Services can be used by You: a) On the Portal/mobile app page, you can view the Famrut Marketplace Products and Services. B) You can manage and maintain Famrut Marketplace Products and Services by related guides provided by Associate. C) You can use the methods recognized by Associate to query the related parameters that are consistent with the selected specifications and models in the order.

Supports of Famrut Marketplace Services

You confirm that you understand that the Associates are Famrut Marketplace Products and Services providers, and Associates will solely assume any and all responsibility and liability related to Famrut Marketplace Products and Services direct and/otherwise. You shall appropriately use Famrut Marketplace Products and Services. Associate shall be liable for providing you with the corresponding products and services support and for providing after sales support related to the Famrut Marketplace Products and Services. Associate shall be solely responsible for handling your consultations and complaints, and related after-sales services that may be required and shall propose solutions within the period as undertaken by the Associate independently. After the Products and Services which you have purchased have been removed from the Famrut Marketplace, Associate may or may not continue to provide service and support for you until the end date of the purchased Famrut Marketplace Products and Services at the description of the Associates independently. We provide support to an extent of online payment disputes, refunds, chargebacks and cancellations to you.

Suspension

We may suspend your right to access or use the Famrut Marketplace requested to do so by Associates or on our own accord and discretion if: (a) your access and use of the Famrut Marketplace is in violation of the Acceptable Use Policy as set out in Definition Section, These Terms and/or any applicable laws and/or regulations; (c) you are in breach of your payment obligations; (d) your access and use of the Famrut Marketplace may pose a security risk /threat to the Famrut Marketplace, us or third parties under the circumstances; (e) your access and use of the Famrut Marketplace may adversely impact the functionality, availability or operation of the Famrut Marketplace; (f) it is required under any applicable law and/or regulations or governmental body; (g) your access and use of the Famrut Marketplace may subject us, our affiliates or subcontractors to liabilities or regulatory compliance risks; (h) you and/or Associates infringe or threaten to infringe or in our reasonable opinion and belief may possibly infringe a third party’s intellectual property rights; or (i) you have ceased to operate in the ordinary course, dissolved or you have resolved to enter or are placed under or applied for voluntary or compulsory liquidation (whether provisional or final) or upon you entering into business rescue proceedings or the like. You acknowledge and agree that (a) suspension does not excuse or waive your payment obligation(s) for the service fees charged during or for the suspension period; and (b) you will not be entitled to any refund or service credits due to any such suspension so effected under the circumstances

DATA PRIVACY

Data Disclosed

If you access or purchase Famrut Marketplace Products and Services, you agree that we may share with Associate your registration information and other details that are necessary for transaction on Famrut Marketplace and you consent for the same.

Associate Privacy Practices and Statements

You are aware that the Associates are responsible for providing privacy statements to you and describe their independent privacy practices/policies with regard to your data that they collect from Famrut Marketplace or disclosed by Famrut Marketplace. Our Privacy Statement will not apply to any Famrut Marketplace Products and Service or to Associates’ use of any of your data or information.

You are aware that the Associate shall be solely responsible for your personal data and other data protection and security independently.

USE AND SUPPORT

EXTENT OF LIBAILITY

IN NO EVENT SHALL FAMRUT MARKETPLACE OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING DAMAGES FOR LOSS OF REVENUES, PROFITS, OPPORTUNITIES, CUSTOMERS, GOODWILL, REPUTATION, DATA OR DATA USE), EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

PLATFORM LIABILITIES

FAMRUT MARKEPLACE ONLY PROVIDES THE MARKETPLACE AS A SALES PLATFORM AS PER THESE TERMS. FAMRUT DOES NOT PROVIDE ANY EXPRESSED OR IMPLIED WARRANTY OR LIABILITIES FOR ANY FAMRUT MARKETPLACE PRODUCT AND SERVICE ON THE FAMRUT MARKETPLACE. UNDER THESE TERMS, FAMRUT MARKETPLACE SHALL NOT ASSUME ANY LIABILITIES ON BEHALF OF THE ASSOCIATE AND ITS FAMRUT MARKETPLACE AND THE ASSOCIATE SHALL BE SOLELY AND FULLY LIABLE TO YOU FOR ANY LOSSES OR DAMAGES OR OTHERWISE YOU MAY SUFFER DURING YOUR USE OF THE FAMRUT MARKETPLACE PRODUCTS AND SERVICES. THERE SHALL BE NO PRIVITY BETWEEN FAMRUT MARKEPLACE AND YOU IN THIS REGARD. YOU SHALL KEEP FAMRUT MARKEPLACE INDEMNIFIED IN THIS REGARD IN ALL CIRCUMSTANCES.

FORCE MAJEURE

FAMRUT Marketplace shall not be liable for any delay for failure to perform its obligations under these Terms where such delay or failure is caused by a force majeure event(s) beyond its reasonable control. Force Majeure events shall include, but not be limited to, acts of God, earthquake, storms, act of war, hostility, sabotage, act of governmental order, electrical, internet or telecommunication outage, blockages, sanctions, denial orders, embargoes, pandemic and riots. Notwithstanding the above, this section does not excuse your payment obligations hereunder.

GOVERNING LAW AND VENUE

This Agreement and any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including any dispute or claim relating to non-contractual obligations) will be governed by and construed in accordance with laws of India. These Terms and Conditions are subject to an exclusive jurisdiction of the Courts at Nashik, Maharashtra, India.

CHANGES AND MODIFICATIONS

Changes

IWe may change or discontinue Famrut Marketplace or change or remove any or all functionality of the Famrut Marketplace from time to time and at our sole and absolute discretion. There shall not be any individual Notice or otherwise communication given in this regard.

Modifications

We may modify these Terms, including the documents and policies referenced herein, at any time and at our sole and absolute discretion by posting a revised version on the Mobile App/Website. Except as is otherwise indicated in the modified Terms, documents or polices, the modified Terms will come into effect upon posting or notification. You undertake to review such Terms regularly on the Mobile App/Website. Your continuous use of the Famrut Marketplace after the effectiveness of such modification shall be deemed as your due acceptance of the documents and policies referenced herein and its particular version in force at the particular time and agree to be bound by the modified Terms as may be in force at any particular time.

Disclaimer

. Non-breach

You agree that the following events or actions implemented by Famrut Marketplace does and will not constitute a breach of these Terms: (a) Service interruptions due to network adjustment and maintenance by Associate and/or Famrut Marketplace or slow access to the Famrut Marketplace Products and Services due to Internet congestion; (b) Taken into account of the special characteristics of computers and the Internet, events arising from hackers' attacks, viruses, technical renovation in the telecom departments and / or the disconnection of the backbone line; (c) Unavailability of Your services or Content caused by the operations and maintenance implemented by Associate and/or Famrut Marketplace, provided that Associate and/or Famrut Marketplace gives prior notice to You with regard to data backup, service migration, or service suspension. Such operations and maintenance include, but are not limited to, troubleshooting, system upgrades, system optimization, and system capacity expansion.

Famrut Marketplace Services, Advertising and Intellectual Property Right

You understand that Associate is solely responsible for any liability of advertising and intellectual property right related to Associate’s Famrut Marketplace Products and Services.

Platform Problem

We do not guarantee to completely handle any technical faults and network problems on the Famrut Marketplace

DEFINITIONS

Unless otherwise specified, the capitalized terms used in these Terms will have the same meaning as defined in Famrut Marketplace Customer Agreement.

• "Associate" refers to third party service provider that is entitled to sell the Products and Services to you on the Famrut Marketplace.
• "Famrut Marketplace" refers to a neutral e-commerce platform that is established and operated by Famrut for offering products and services (which are independently developed by Associates or legally provided by Associates authorized by the relevant rights holders) traded on the Famrut Marketplace, including but not limited to the following product and service categories: Banking, Insurance, Crop Advisory, Labours, Traders, Vet Doctors, Soil Testing, Equipments, Training, Agri Services, Government Advisor, Universities, Transport, Food Processing, Cold Storage, Tissue Culture, Nutrients, Hybrid Seeds, Pesticides, Hardware, Fertilizers, Seeds, Grain, Tools and Instruments. You could make transaction with Associate on this platform like purchasing Famrut Marketplace Products and Services from Associates. These services are solely provided and supported by Associates.
• “Famrut Marketplace Customer Agreement” refers to an independent agreement provided by Associate and signed/accepted/executed/otherwise acted upon between you and Associate to regulate how you using its Famrut Marketplace Products and Services and other related issues.

Acceptable Use Policy

(For end customer on using the FAMRUT Application)

This Acceptable Use Policy (the “AUP”) describes the prohibited usage of the Products and Services provided and/or made available by or on behalf of Famrut and its affiliates. This AUP is an integrated part of the Famrut Customer Agreement (the “Agreement”). The examples and restrictions described herein are not exhaustive. We may update this AUP from time to time at our discretion by posting the latest and updated version on the Site. By using the Products and Services, you agree to be bound by the latest and updated version of the AUP as may be in force at any particular time. You acknowledge and agree that we may suspend or terminate the Services if you and/or your End User violate this AUP. Defined term used herein shall have the same meaning as defined in the Agreement.

Prohibited Activities

You may not access and use, or allow others to access and use the Services to:

• violate any applicable local, national or international laws, regulations and rules.
• violate or otherwise encroaches on the rights of others, including but not limited to privacy or Intellectual Property Rights.
• conduct, promote, facilitate or allow illegal, unlawful, infringing, harmful or fraudulent activities, including but not limited to any activity for the purpose of harming or attempting to harm minors in any way, pornography, illegal gambling, Ponzi, network attack, phishing, or damage, surreptitiously intercept any system, program or data, monitoring of data or traffic of Services without our permission.
• transmit, offer, upload, download, use or re-use, disseminate or distribute any unlawful, infringing, offensive, harmful contents or materials, including but not limited to those set out in the section "Prohibited Content" below.
• transmit any data, send or upload any material that contains viruses, worms, Trojan horses, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation or security of any computer software or hardware.
• attack, interfere with, disrupt or adversely affect any Services, hardware, software, systems, sites or networks, including but not limited to using high volume automated means (including robots, spiders, scripts or similar data gathering or extraction methods) to access or attack any Services, hardware, software, systems, sites or networks.
• access to any portion of the Services, accounts or systems without authorization, or attempt to do so.
• violate or adversely impact the security or integrity of the Services, hardware, software, systems, sites or networks.
• distribute, transmit or send unsolicited email mass e-mail or other messages, promotions, advertising or solicitations (like “spam”).
• fraudulently offer goods or services, or any advertising, promotional or other materials that contain false, deceptive, or misleading statements or representations.
• Content that infringes or misappropriates or otherwise violates or interferes in the intellectual property or proprietary rights of others.
• Content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable, including content that constitutes child pornography, relates to bestiality, or depicts non-consensual sex acts.
• Content or other computer technology or any other technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.
• Violate any charters, policies, rules or agreements promulgated by any search engines, subscription Web services, chat areas, bulletin boards, Web pages, or other services accessed via the Services or Infrastructure (“Usenet Rules”), including, without limitation, any cross postings to unrelated news groups, continued posting of off-topic messages, and disrupting newsgroups with materials, postings, or activities that are inappropriate (as determined by Famrut in its sole discretion).
• Violate the applicable acceptable use policies of other ISPs when data, content, or other communications are carried across the networks of such ISPs.
• You may not use the Products and Services to promote or condone hate or violence against people based on race, ethnicity, colour, national origin, religion, age, gender, sexual orientation, disability, medical condition, veteran status or other forms of discriminatory intolerance. You may not use the Products and Services to promote or support organizations, platforms or people that: (i) promote or condone such hate; or (ii) threaten or condone violence to further a cause.
• You shall not use or offer Products and Services, or post or upload Materials, that contravene or that facilitate or promote activities that contravene, the laws of the jurisdictions in which you operate or do business.
• You shall not post or upload any Materials that contain personally identifiable information, sensitive personal information, or confidential information, such as credit card numbers, confidential national ID numbers, or account passwords unless you have consent from the person to whom the information belongs or who is otherwise authorized to provide such consent.
• You shall not use or offer Products and Services, or post or upload Materials, that promote self-harm
• You shall not use or offer Products and Services, or post or upload Materials, that imply or promote support or funding of, or membership in, a terrorist organization.

Prohibited Content

These content prohibitions apply to any and all traffic that you transmit via the Services. Your Content shall not:.

• be defamatory, obscene, offensive, hateful or inflammatory
• promote violence, sexually explicit material, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age or any other grounds
• infringe any Intellectual Property Rights.
• be likely to false, deceive or mislead.
• promote, advocate, incite or assist any illegal activities.
• be threatening, abuse, violate or invade third party's privacy; or
• contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.

Our Monitoring and Enforcement

We reserve the right to investigate any violation of this AUP or any misuse of the Services and the Website and bring it to the notice of the respective law governing /enforcing authorities as the case may be without any liability on our part. If there is any violation or suspected violation, we may take any of the following actions at our discretion (without prejudice to any of our other rights or remedies under the Agreement). Failure to comply with this AUP constitutes a material breach of the Agreement.

• investigate violation of this AUP or misuse of the Services or Site;
• investigate and help prevent security threats, fraud, or other illegal, infringing or harmful activities.
• remove, block, disable access to, or modify any contents or materials, including but not limited to Your Content
• issue a warning to you and require you to rectify
• commence legal proceedings against you for reimbursement of all costs on an indemnity basis (including but not limited to, reasonable administrative and legal costs) resulting from the breach.
• take further legal action against you
• suspend or termination of your account, provision of Products and Services to you, your Order or the Agreement immediately, and Your Content stored in the Products and Services environment may be deleted immediately.
• report your violation to appropriate law enforcement agencies or other appropriate third parties as the case me be, without any liability on our part.

Report Violation of this AUP

If you become aware of any violation of this AUP, you will immediately notify us and provide us with all possible assistance to stop or remedy such violation at the earliest. You may contact us to report any violation of this AUP.

Extent of Liability and Jurisdiction

IN NO EVENT SHALL FAMRUT OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OR LIABILITY OF WHATSOEVER NATURE OR ANY OTHER ACTION (CIVIL OR CRIMINAL OR OTHERWISE) IN THE EVENT OF PERFORMANCE/COMMISSION OF ANY OF THE PROHIBITED ACTIVITIES BY YOU ENUMERATED HEREINABOVE. THIS POLICY IS SUBJECT TO LAWS OF INDIA AND AN EXCLUSIVE JURISDCITION OF NASHIK, INDIA .

Famrut- Refund & Cancellation Policy

(Return and Exchange Policy)

We endeavour to provide the best quality products every single time you order with us. Famrut's Return and Exchange Policy offers no return of goods once delivered. If you choose to exchange the item for reason of mismatch of product or receipt of a defective or expired item, you will be provided with a replacement of the item, free of cost. However, an exchange is subject to availability of the product in our stock and will be dependent on the sellers return and exchange policy.

For any exchange, please contact us via e mail at getintouch@famrut.com. within 72 Hrs of the receipt of product.

The following EXCEPTIONS and RULES apply to this Policy:

1. All items to be returned or exchanged must be unused and in their original condition with all original labels and packaging intact, and should not be broken or tampered with.
2. Exchanges are allowed only if your address is serviceable for an Exchange by our logistics team.
3. In case you had purchased a product which has a free gift/offer/reward points associated with it and you wish to return the item, maximum of Refunds/Free item MRP will be debited until the satisfactory receipt of all free gift(s)/offer item(s) that are shipped along with it
4. If you choose to self-ship your returns, kindly pack the items securely to prevent any loss or damage during transit. All returns, exchange, refunds in such cases will be initiated only after actual receipt of return. For all self-shipped returns, we recommend you use a reliable courier service.
5. You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
6. Perishable goods (such as seeds and flowers) cannot be returned, if the packet is opened or damaged.

Cancellation Policy

For Cancellations please contact us via e mail at getintouch@famrut.com within 24 Hrs of the purchase. As soon as we receive your cancellation order, we will initiate your refund within fifteen working days. The refund will be done via original method of the payment.
The seller and the end-customers have the option to cancel the order only in case when he has placed the order and Supplier is yet to Dispatch the order. The Supplier gets 48 hours to process the order.
Also, when the product is delivered to the end-customer, the end-customer has the option to arrange for a return within 7 days of delivery of the product. The return will be done as long as it is unused, undamaged and with all original tags & packaging intact.
Once the return is scheduled by the end-customer, company will get the pickup done by the logistics partner.

REFUND POLICY

Once the cancellation is done by the end-customer, we initiate the refund within 3-4 working days. The end-customer will receive the refund in his back account within 10-15 working days after the return request is initiated.
Above Refund and cancellation policy may change from time to time and shall be updated on Famrut Mobile App accordingly.

Fixed Fees

Fixed Fee is a small amount charged for every successful sale transaction. A successful sale transaction is an order which has been successfully delivered to the customer. In case of any customer return, this fee is charged. Also, this fee varies based on the order item value irrespective of the category and seller tier.

Note : The fees mentioned above is subject to change without prior notice.

Famrut- Shipping & Delivery Policy

• Once the order is placed on Famrut, the order details will be shared with the seller. It is the seller’s responsibility to pack and ship the product in neat and proper condition in order to deliver the same to the buyer without any damage.
• Famurt is not liable for any delay in delivery by the seller.
• The expected delivery timeline will be between 7 to 15 working days post confirmation of the order by the seller.
• Famrut cannot hold liable for delay in dispatching the order by the seller due to an unforeseen circumstance.
• Delivery of all orders will be done at registered address of the buyer (Unless specified at the time of Order).
• Famrut is not responsible for any damage to the shipment/order during transit to the buyer.
• All shipments/items/orders (including gifts) will be shipped by the seller with an invoice mentioning the price, as per Indian Tax Regulations.
• Orders are shipped by the seller through registered domestic courier companies and /or speed post only. Orders shall be shipped within 7-10 working days or as per the delivery date agreed at the time of order confirmation, Delivery of the shipment is subject to seller’s Courier Company /post office norms.
• Famrut will help the buyer in case of any disputes raised at the time of delivery. The order(s) may also be verified further by our customer experience team.
• Buyer shall enter detailed and correct shipping address (Street number and name, landmark, City, State, and Pin code).
• Buyer would be liable to pay the charges for re-delivering the product, if the order has not delivered and returned due to its unavailability.
• The Company/Website does not track the shipment or follow up with the third-party logistics companies which the seller has tied up with.
• Order could be cancelled if it does not matches the billing address provided by the buyer

Overall Impression: A pale, somewhat spicy, dry, strong Trappist ale with a pleasant rounded malt flavor and firm bitterness. Quite aromatic, with spicy, fruity, and light alcohol notes combining with the supportive clean malt character to produce a surprisingly drinkable beverage considering the high alcohol level.
